01Agreement to these terms

These Terms of Service (“Terms”) govern your use of the Qodart desktop application, its related tools and this website (together, the “Service”), provided by Artims Infotech (“we”, “us”), Siliguri, West Bengal, India. By downloading, installing or using the Service you agree to these Terms. If you do not agree, do not use it.

If you use Qodart on behalf of a company, you confirm you can bind that company to these Terms.

02License to use Qodart

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Qodart on devices you own or control, for lawful purposes and in line with these Terms. Qodart is currently in early access, and features, limits and availability may change.

You may not copy, resell, sublicense, reverse engineer or attempt to extract the source of Qodart except where the law gives you that right despite this restriction, or where a component is provided under an open-source licence that says otherwise.

03Pricing and early access

Qodart is completely free to use for now. We may introduce paid plans or subscriptions in the future. If we do, we will announce them clearly in advance, and you will never be charged unless you choose a paid plan and agree to it. Features you already use will not suddenly start billing you.

Separately from Qodart, the AI providers, subscriptions and services you connect may charge you under their own terms. Those costs are yours and are not set or collected by us.

04Your projects and code

You own the projects you create or open with Qodart, including the Dart and Flutter code in them. Qodart does not use a proprietary format: projects are standard Flutter projects you can build, edit and keep in any Git host, with or without Qodart.

You are responsible for the content of your projects and for having the rights to anything you bring into them. To the extent allowed by law and by your AI provider’s terms, you also own the code the agent generates for you.

05AI features

  • Bring your own provider. You connect your own API keys, subscription sign-ins, local models or CLI agents. You are responsible for those accounts, their fees, usage limits and their terms of service. We do not add a markup to model usage.
  • Outputs can be wrong. AI-generated code and suggestions may be incorrect, insecure, incomplete or similar to existing code. Review changes before you run, ship or publish them, and use version control.
  • You set the permissions. The agent can only do what its permission level and tool rules allow. If you choose full access or let it run commands, you accept the consequences of what it does in your project and environment.

06Acceptable use

You agree not to use Qodart to:

  • break the law or infringe someone else’s rights;
  • build or distribute malware, or attack systems you do not have permission to test;
  • violate the terms of an AI provider, GitHub or any other service you connect;
  • interfere with, overload or attempt to gain unauthorised access to the Service or other people’s data.

07Running code and workspace trust

Qodart can build and run Flutter and Dart code, open terminals and launch CLI agents. Code from untrusted sources can be harmful. New folders open in restricted mode, and you should only trust folders whose contents you have checked. You are responsible for what you choose to run.

08Third-party services and software

The Service works with third-party tools, including AI providers, GitHub, the Flutter and Dart SDKs, MCP servers and open-source components. They are provided under their own licences and terms, which apply to your use of them. We are not responsible for third-party services.

09Our intellectual property

Qodart, its name, logo, design and the software we provide are owned by Artims Infotech and its licensors and are protected by intellectual-property laws. These Terms do not give you any right to use our names or branding except to refer to Qodart accurately.

10Disclaimer of warranties

The Service is provided “as is” and “as available”, particularly while in early access. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Service will be uninterrupted, error-free or free of data loss.

11Limitation of liability

To the maximum extent permitted by law, Artims Infotech will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim (currently nothing, as Qodart is free) or USD 100, whichever is greater. Some places do not allow these limits, so they apply only as far as the law permits.

12Termination

You can stop using Qodart at any time by uninstalling it. We may suspend or end access to the Service if you breach these Terms or if we need to protect the Service or others. Because your projects live on your own machine, ending your access does not delete your code.

13Changes to the Service and these Terms

We may update Qodart and these Terms from time to time. We will change the “last updated” date above, and for material changes we will give a clear notice. If you keep using the Service after a change takes effect, you accept the updated Terms.

14Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-law rules. Courts at Siliguri, West Bengal, will have jurisdiction over any dispute, unless local consumer law gives you the right to another forum.
